Today, on January 11, 2022, the U.S. Environmental Protection Agency (EPA) issued a decision on your 40 C.F.R. § 257.103(f)(1) or (f)(2) extension request. EPA reviewed the Part A alternative closure demonstration you submitted and determined that the demonstration is complete. In accordance with 40 C.F.R. § 257.103(f)(3)(ii), the deadline to cease receipt of waste for the CCR surface impoundment(s) the demonstration covered is tolled until EPA issues a final decision on your demonstration. Attached is an official letter stating EPA’s determination. Please add this letter to the CCR compliance website for the facility as required by 40 C.F.R. § 257.107(i)(15) and (19). The Agency will announce proposed determinations on the demonstrations as expeditiously as possible. |
